Coercive action by municipal corporation on their tenants should be stayed: CAMIT
Delegation of Chamber of Association of Maharashtra Industry & Trade (CAMIT) under leadership of Krupal Tuman, Member of Parliament and Ashsih Jaiswal, MLA met Minister for Urban Development and Public Works, Government of Maharashtra, Eknath Shinde during his brief halt at Nagpur on Wednesday.
Dipen Agrawal, President – CAMIT welcomed Eknath Shinde with floral bouquet and submitted memorandum requesting him to intervene and resolve the problems faced by MSME units from Nagpur Rural by NMRDA action and galedharak (tenants) of Municipal Corporations across the state due to unilateral exorbitant increase in rent by corporations.
Agrawal apprised minister for UDD with the fact that the state administration in September 2019 notified the Maharashtra Municipal Corporation (Renewal of Lease or Transfer of Immovable Property) Rules without following due process of law. The then administration neither provided opportunity of personal hearing to objectors nor considered the objections submitted in response to the draft rules published in May 2019 calling objections and suggestions. Thus, the 2019 notification should be withdrawn and just and equitable revision be made demanded Agrawal.
Ashok Sanghvi, executive member CAMIT (Nagpur) during discussions informed that even though the trader is ready to deposit rent as per old rent till the issue of unilateral increase of rent is decided by UDD, the Corporations are not accepting the rent and initiating eviction proceeding without there being any intentional default on part of the tenants. The eviction proceedings should be stayed prayed Sanghvi.
Sanjay K. Agrawal, Vice President, CAMIT (Nagpur) highlighted the hardship faced by the MSME units established in Nagpur rural area due to illogical diktat of NMRDA to close the units and/or restore the land to its use prior to alleged unauthorised development. The draft DCPR (2012-32) for Nagpur Metropolitan Region was published in 2015 and the final DCPR (2012-32) was notified by State Government in 2018, hence it is unjust on part of NMRDA to retrospectively implement the provisions of DCPR notified in 2018 and expect MSME’s established before 2018 to comply with them.
Krupal Tumane (MP) summing-up the submissions said the NMRDA actions affect the livelihood of employers and employees of his constituency. If the units are closed due to impractical approach and actions on part of NMRDA it will increase unemployment and NPA in banks. Tumane impressed upon Eknat Shinde, Minister UDD to personally intervene in both the matters and stay the coercive actions by Municipal Corporations and NMRDA till they are resolved in an amicable manner. The request was well received by Minister UDD, who assured to shortly convey a joint meeting to address the concerns raised.
Dipen Agrawal on behalf of business community of state expressed gratitude to Eknath Shinde Minister UDD for sparing time and patiently hearing the issues. He also thanked Krupal Tumane (MP) and Ashish Jaiswal (MLA) for supporting the cause of trade and commerce.
